SG Loyalty Program — Terms and Conditions
Effective date: 26/10/2026.
1. General Provisions
1.1. The SG Loyalty Program (the “Program”) is operated and administered by the commercial entity responsible for the Scent Gallery online store, as identified in the general Terms of Service (the “Operator”, “Scent Gallery”, “we”, “us”, or “our”).
1.2. The Program is designed to recognize and reward customer loyalty by offering promotional points, rewards, discounts, exclusive benefits, personalized offers, and access to VIP membership tiers.
1.3. Participation in the Program is entirely free of charge and does not require any separate enrollment, subscription, or administration fees.
1.4. These Program Rules establish the general conditions governing participation, point accumulation and redemption, reward mechanisms, validity periods, eligibility requirements, and the respective rights and obligations of participating customers.
1.5. The Program is managed through a digital loyalty system integrated into the Scent Gallery website. Up-to-date information regarding available rewards, earning opportunities, redemption requirements, and VIP benefits is displayed in the Loyalty Hub, accessible through the customer account, and through the loyalty widget displayed on the left side of the screen, where supported by the device and interface.
1.6. Point values, earning rates, qualification thresholds, available rewards, and VIP benefits may change over time. The conditions applicable to each offer are displayed within the Program interface and should be reviewed before completing the relevant activity or redeeming a reward.
1.7. The conditions of an offer validly presented at the time of participation shall be respected in accordance with applicable law, subject to the correction of manifest, objectively verifiable errors under these Program Rules.
2. Automatic Enrollment and Participation
2.1. By creating a customer account on the Scent Gallery website, the customer is automatically and immediately enrolled, free of charge, in the SG Loyalty Program. The Program becomes active upon successful account creation, without requiring a separate enrollment procedure, additional registration, or subsequent activation.
2.2. Once enrolled, customers may automatically accumulate loyalty points and access eligible rewards and benefits, subject to the eligibility, validation, availability, and redemption conditions established in these Program Rules.
2.3. Existing customers may also be automatically included in the Program in accordance with the activation and migration procedures implemented by the Operator.
2.4. The Program forms part of the services and benefits associated with a Scent Gallery customer account. These Program Rules are incorporated into the Scent Gallery Terms of Service. Where customers expressly accept the Terms of Service during account registration, such acceptance also extends to these Program Rules. Automatic enrollment and the applicable terms must be clearly disclosed before account creation.
2.5. The Program is intended for individual consumers making purchases for personal use. Business-to-business transactions, wholesale purchases, and purchases made for professional or commercial purposes are not eligible unless expressly authorized by the Operator.
2.6. Each customer must maintain a personal account containing accurate and current information. Creating multiple, fictitious, or misleading accounts for the purpose of improperly obtaining loyalty benefits is prohibited.
2.7. Enrollment in the Program does not constitute consent to receive marketing communications by email, SMS, or other electronic channels. Marketing preferences and consent are managed separately in accordance with applicable law.
2.8. Customers may withdraw from the Program at any time, without closing their customer account, in accordance with Section 17 of these Program Rules.
3. Legal Nature and Promotional Character of Loyalty Points
3.1. SG loyalty points (“SG Points” or “Points”) are promotional reward units made available by the Operator as part of the Program, subject to these Program Rules.
3.2. Points are granted as ancillary promotional benefits in connection with eligible activities. They are not products purchased separately, electronic money, bank deposits, investment instruments, or independent payment instruments.
3.3. Points do not have an independent monetary or cash value. They cannot be directly converted into cash, exchanged for money, or redeemed for a monetary refund, except where mandatory applicable law provides otherwise.
3.4. Points may not be sold, assigned, transferred between customer accounts, exchanged through unauthorized third parties, or otherwise commercially exploited without the Operator’s express authorization.
3.5. Holding a balance of Points provides the opportunity to access eligible rewards available through the Program, subject to applicable conditions, validity periods, availability, and redemption requirements.
3.6. The promotional and complimentary nature of Points does not exclude the Operator’s obligation to honor validly granted benefits, provide accurate commercial information, or respect mandatory consumer protection rights.
3.7. No ownership interest, financial entitlement, or right to monetary compensation arises solely from holding a balance of Points, except where such a right is established by mandatory applicable law.
4. Earning Loyalty Points
4.1. Customers may earn Points through eligible purchases and participation in activities, promotional campaigns, and other earning opportunities made available through the Program.
4.2. Earning opportunities may include, without limitation:
- Placing eligible orders on the Scent Gallery website.
- Creating a customer account.
- Voluntarily subscribing to marketing communications.
- Participating in eligible social media activities.
- Following or interacting with Scent Gallery’s official social media accounts.
- Submitting authentic product reviews.
- Participating in promotional activities or special campaigns.
- Birthday or anniversary-related rewards, where available.
- Reaching specified purchase or activity milestones.
- Purchasing eligible products or collections.
- Completing other qualifying actions displayed within the Program.
4.3. The above examples are provided for illustrative purposes only and do not guarantee that any particular earning method will be available at all times. Only earning methods displayed as active and available within the Program interface at the time of participation shall apply.
4.4. The number of Points awarded for each eligible activity, applicable conditions, limitations, and earning requirements are displayed in the Loyalty Hub and the loyalty widget.
4.5. For qualifying purchases, Points are calculated based on the eligible value of purchased products after applicable discounts. Under the Program’s standard configuration, the calculation includes applicable product taxes but excludes shipping charges.
4.6. Certain products or categories, including gift cards, samples, or items specifically designated as ineligible, may be excluded from earning Points.
4.7. Certain campaigns or promotional activities may be subject to additional eligibility requirements, participation limits, frequency restrictions, or other conditions, which will be communicated as part of the relevant offer.
4.8. Where purchases are made in currencies other than the Program’s reference currency, point calculations and VIP qualification progress may involve currency conversion and rounding according to the rules applied by the loyalty system.
4.9. Repetitive, simulated, unauthorized, misleading, or artificial activities intended to manipulate the Program or obtain unjustified rewards may be deemed ineligible.
4.10. Previous or historical purchases do not automatically qualify for retroactive Points unless the Operator expressly introduces a campaign or rule allowing such allocation.
4.11. The Operator may establish reasonable limits on earning opportunities to prevent abuse, technical exploitation, or disproportionate accumulation, provided such limits are clearly communicated and applied in accordance with applicable law.
5. Validation and Availability of Points
5.1. Points earned through purchases are awarded only after the relevant order satisfies all applicable eligibility and validation requirements.
5.2. As a general rule, a qualifying order must be confirmed as paid and fully fulfilled or dispatched before the Points associated with that order become eligible for availability.
5.3. Points earned from eligible purchases become available for redemption after a waiting period of 15 calendar days following the fulfillment of both the payment and full-dispatch requirements.
5.4. During this waiting period, Points may appear in the customer account as pending Points and cannot be redeemed until they become available.
5.5. Points associated with canceled, unpaid, incomplete, fraudulent, fully refunded, or otherwise ineligible orders may be withheld, canceled, or removed, as appropriate.
5.6. In the event of partial returns, partial refunds, or order adjustments, the Operator may proportionally recalculate Points based on the remaining eligible order value.
5.7. The 15-day waiting period is an internal Program validation rule and does not modify, replace, or restrict any statutory withdrawal period or other mandatory consumer rights.
5.8. Technical processing times may affect when account balances are updated. Such delays do not authorize the Operator to unjustifiably withhold Points validly earned under the applicable Program conditions.
6. Expiration of Loyalty Points
6.1. Loyalty Points are subject to an expiration policy based on eligible account activity.
6.2. The entire available Points balance expires after 12 consecutive months without any qualifying point-earning or point-redemption activity.
6.3. The 12-month inactivity period is calculated from the most recent qualifying activity recorded by the loyalty system.
6.4. A new qualifying earning or redemption activity resets the inactivity period for the entire Points balance, in accordance with the Program’s operating rules.
6.5. Merely logging into an account, browsing the website, or viewing the Points balance does not, in itself, constitute qualifying activity for resetting the expiration period.
6.6. Following valid expiration, expired Points are removed from the available balance and can no longer be redeemed or converted into monetary compensation.
6.7. Expiration rules shall not be applied in a manner that unlawfully deprives customers of benefits affected by errors attributable to the Operator or in circumstances where mandatory law requires their preservation or reinstatement.
6.8. Store credits issued as rewards, where available, are distinct from loyalty Points and are governed by their own conditions and applicable legal requirements.
7. Redeeming Points and Obtaining Rewards
7.1. Customers may redeem available Points for rewards offered through the Program.
7.2. Depending on availability, rewards may include:
- Percentage-based discounts on eligible orders.
- Fixed-value discounts.
- Discounts applicable to selected products.
- Discounts applicable to particular collections.
- Free shipping offers, subject to the applicable conditions.
- Store credit rewards, where supported and available.
- Other promotional benefits expressly displayed within the Program.
7.3. The Operator may introduce additional reward categories compatible with the Program’s technical functionality and applicable law.
7.4. The Points required for each reward, reward value, eligible products, minimum purchase requirements, redemption limits, and any additional conditions are displayed in the Loyalty Hub before the customer confirms redemption.
7.5. Rewards may be general, personalized, exclusive, product-specific, collection-specific, limited in quantity, or subject to product availability.
7.6. Redeeming a reward deducts the corresponding number of Points from the customer’s available balance.
7.7. The number, categories, values, and availability of rewards may change over time in accordance with Section 14. The previous availability of a particular reward does not guarantee that the same reward will remain available indefinitely.
7.8. Rewards may be restricted to online purchases, particular markets, products, collections, customer categories, or other qualifying conditions, as communicated before redemption.
7.9. Having a sufficient Points balance does not guarantee the availability of any particular product or reward.
7.10. Customers are responsible for reviewing the applicable reward conditions before confirming redemption.
8. Reward Codes — Validity and Use
8.1. When redeeming Points generates a promotional discount code, that code is subject to the specific conditions associated with the selected reward.
8.2. Promotional discount codes generated through Points redemption are valid for 7 calendar days from their date of issuance.
8.3. Once the validity period has expired, the code can no longer be applied to a new order.
8.4. Reward codes are generally intended for single use and are restricted to the eligible customer account for which they were issued. Unauthorized transfer, distribution, resale, or commercial exploitation is prohibited.
8.5. If an unused reward code expires, the Points deducted to generate that code are automatically returned to the customer’s loyalty balance, in accordance with the Program’s configured functionality.
8.6. Returned Points remain subject to the Program’s general eligibility and expiration rules.
8.7. Points are not automatically refunded for reward codes that have already been used, except where required by the applicable Program conditions or mandatory law.
8.8. Expired, used, legitimately invalidated, or fraudulently obtained codes are not automatically reactivated.
8.9. Rewards issued as store credits, where available, are governed by their specific conditions and applicable law and are not automatically subject to the standard 7-day validity period applicable to promotional discount codes.
9. VIP Loyalty Tiers
9.1. The Program includes a VIP tier system through which eligible customers may access additional benefits based on their qualifying purchasing activity.
9.2. VIP tiers may provide benefits such as special discounts, enhanced point-earning rates, exclusive rewards, personalized offers, access to selected promotional campaigns, or other advantages displayed within the Program.
9.3. Tier names, qualification thresholds, earning multipliers, and associated benefits are displayed in the Loyalty Hub and may be updated in accordance with Section 14.
9.4. VIP qualification is determined using a rolling 12-month evaluation period.
9.5. During each evaluation, the system considers eligible purchasing activity recorded during the preceding 12 months rather than the customer’s entire historical purchasing activity.
9.6. When a customer reaches the qualification requirements for a higher tier, the system may automatically upgrade the customer to the corresponding VIP level.
9.7. If a customer’s eligible activity falls below the threshold required to maintain their current VIP tier, a 7-calendar-day grace period applies, during which the existing tier is temporarily maintained.
9.8. If the qualification requirements are not satisfied by the end of the grace period, the system may automatically adjust the customer’s VIP status to the appropriate tier.
9.9. VIP membership status is not permanent or guaranteed for life unless a particular offer expressly provides otherwise.
9.10. Changes to VIP status shall not retroactively affect completed orders or rights already validly acquired under applicable law.
9.11. The Operator may modify future VIP benefits and qualification conditions for legitimate commercial, technical, or operational reasons, subject to the transparency, notice, and consumer protection requirements established in these Program Rules.
10. Discount Combination and Commercial Restrictions
10.1. Loyalty rewards, VIP discounts, and other Program benefits are subject to applicable discount-combination rules and technical checkout restrictions.
10.2. As a general rule, Program rewards and benefits cannot automatically be combined with other promotional codes, discounts, or campaigns unless such combination is expressly permitted and communicated.
10.3. Certain products, collections, gift cards, commercial categories, or order types may be excluded from promotional discounts, subject to conditions disclosed before the benefit is redeemed.
10.4. Rewards may be subject to minimum purchase amounts, individual redemption limits, quantity restrictions, or other specific conditions presented before redemption.
10.5. Discounts cannot be converted into cash and cannot result in a monetary refund exceeding the amount actually paid, without prejudice to mandatory consumer rights.
10.6. If a reward cannot be applied due to objectively applicable eligibility restrictions or incompatibility with other promotions, the customer will be informed through the checkout interface or customer support channels.
10.7. The Operator reserves the right to establish reasonable commercial restrictions on future rewards, provided that such restrictions are transparent, lawful, and do not unjustifiably affect previously acquired rights.
11. Returns, Cancellations, Refunds, and Points Adjustments
11.1. If an order is canceled, returned, refunded, unpaid, or legitimately invalidated, Points originally awarded in connection with that order may be canceled, recalculated, or adjusted accordingly.
11.2. Where Points associated with a subsequently returned or adjusted order have already been redeemed, the Operator may correct the loyalty balance, including through an appropriate adjustment against future eligible earnings, provided such correction is justified and proportionate.
11.3. Such adjustments do not automatically create an obligation for the customer to pay money to compensate for a negative Points balance.
11.4. For orders placed using loyalty rewards, the amount of any monetary refund shall be calculated based on the amount actually paid and applicable statutory requirements.
11.5. The reinstatement of redeemed Points following a returned order shall be assessed according to the nature of the reward, the applicable conditions, and the circumstances of the transaction.
11.6. Nothing in these Program Rules shall limit or exclude statutory withdrawal rights, product conformity rights, mandatory warranties, or other consumer protection rights.
12. Technical, Administrative, and Configuration Errors
12.1. The Operator takes reasonable measures to ensure the accuracy and proper functioning of the Program. Nevertheless, material, technical, administrative, computational, synchronization, integration, currency conversion, or configuration errors may occasionally occur.
12.2. Such errors may affect displayed or awarded Points, account balances, VIP thresholds, discounts, promotional codes, reward eligibility, or other Program functions.
12.3. The Operator reserves the right to investigate and correct manifest, demonstrable, and objectively verifiable errors, including situations in which Points or benefits have been incorrectly awarded in amounts or under conditions materially different from those genuinely established for the relevant offer.
12.4. An accidental allocation of a manifestly disproportionate number of Points resulting from a technical malfunction, configuration mistake, or calculation error does not, by itself, establish the Operator’s intention to grant such a benefit.
12.5. Where an objectively verifiable error has occurred, the Operator may, to the extent permitted by applicable law:
- Correct the affected Points balance.
- Adjust incorrectly recorded values.
- Invalidate unused rewards that were demonstrably issued in error.
- Suspend the affected functionality temporarily.
- Restore the technically correct Program configuration.
- Take proportionate measures to prevent further erroneous allocations.
12.6. Corrections must be supported by verifiable information, which may include transaction records, configuration history, technical logs, campaign conditions, and other relevant evidence.
12.7. Where an error affects a reward already redeemed or an order already accepted, the situation shall be assessed individually, with due regard to applicable contract formation rules, good faith, and consumer protection legislation.
12.8. The Operator is not required to maintain an objectively erroneous technical configuration for future transactions. However, this provision does not authorize the arbitrary cancellation of correctly granted benefits or rights lawfully acquired by customers.
12.9. Customers affected by a significant correction may request an explanation and review of the relevant adjustment by contacting support@scent.gallery.
12.10. All corrections shall be implemented in good faith, proportionately, and in accordance with applicable law. Nothing in this section excludes or limits liability that cannot lawfully be excluded or restricted.
13. Fraudulent or Abusive Use of the Program
13.1. Customers must not use the Program fraudulently, through unauthorized automated mechanisms, or in any manner intended to obtain benefits to which they are not legitimately entitled.
13.2. Prohibited activities include, without limitation:
- Creating fictitious or multiple customer accounts to repeatedly obtain enrollment rewards.
- Simulating purchases, subscriptions, or other qualifying actions.
- Deliberately exploiting technical, calculation, or configuration errors.
- Unauthorized use of another customer’s account or reward codes.
- Artificial manipulation of loyalty balances or VIP qualification requirements.
- Providing false or misleading information to obtain rewards.
- Submitting fraudulent reviews or performing inauthentic promotional activities.
- Circumventing technical restrictions or eligibility requirements.
13.3. Where objective indications of fraud or abuse exist, the Operator may temporarily suspend access to affected rewards or conduct additional reasonable verification procedures.
13.4. If a violation is confirmed, the Operator may cancel improperly obtained benefits, restrict access to the Program, or exclude the participant, provided such measures are proportionate to the nature and seriousness of the violation.
13.5. Measures taken under this section must not be arbitrary, discriminatory, or contrary to mandatory applicable law.
13.6. Customers may request information regarding any restriction or exclusion and seek a review of the decision by contacting support@scent.gallery.
14. Changes, Suspension, and Termination of the Program
14.1. The Operator retains responsibility for and control over the commercial administration, technical operation, and configuration of the Program.
14.2. The Operator may update, for future activities, the available earning methods, point-earning rates, redemption requirements, reward categories, VIP qualification thresholds, eligible products, benefits, and other Program mechanisms.
14.3. Such changes may be justified by evolving commercial conditions, service improvements, changes in applicable law, technical requirements, security concerns, fraud prevention, product availability, or legitimate operational restructuring.
14.4. Changes relating to future offers may be reflected directly in the Loyalty Hub and the loyalty widget without requiring a formal amendment to these Program Rules for each individual promotional value.
14.5. Material changes that adversely affect existing rights or the ability to use benefits already validly acquired shall be communicated within a reasonable period before implementation, generally at least 30 calendar days in advance, except where urgent measures are justified by legal obligations, security risks, fraud, or manifest technical errors.
14.6. As a general rule, changes to future earning rates and reward conditions shall not retroactively affect qualifying activities already completed under a valid offer.
14.7. The Operator may temporarily suspend specific Program functions for maintenance, technical repairs, system protection, or the prevention of unauthorized activity.
14.8. If the Operator decides to permanently discontinue the Program, customers shall receive reasonable prior notice, together with information regarding the treatment of existing balances and a fair opportunity to redeem validly earned and unexpired Points, subject to applicable law.
14.9. Nothing in this section grants the Operator an unrestricted right to arbitrarily remove correctly earned Points or validly acquired rewards.
14.10. The Operator shall implement Program changes transparently, in good faith, and in compliance with applicable consumer protection requirements.
15. Technical Availability and Service Continuity
15.1. The Program operates through digital services, software components, and third-party technological integrations that may occasionally require maintenance, updates, or technical intervention.
15.2. While the Operator does not guarantee uninterrupted availability of every technical component, reasonable efforts will be made to maintain the Program and resolve identified malfunctions.
15.3. In the event of temporary unavailability, customers may contact customer support to request assistance with their Points balance or a particular reward.
15.4. Technical disruptions do not justify the unlawful removal of correctly acquired benefits or the restriction of mandatory consumer rights.
15.5. The Operator shall not be liable for losses arising exclusively from force majeure events or other legally recognized grounds for exemption from liability, to the extent and under the conditions permitted by applicable law.
16. Complaints and Account Balance Verification
16.1. Customers who identify discrepancies concerning Points, rewards, VIP status, or other Program functions may request verification by contacting support@scent.gallery.
16.2. Requests should contain sufficient information to identify the relevant account and explain the discrepancy. The Operator may request additional reasonable information necessary to investigate the matter.
16.3. The Operator will review the request using available records and correct any identified errors where appropriate.
16.4. Technical records are not considered final or beyond challenge where their accuracy is reasonably disputed. Customers retain the right to contest errors and use available legal dispute resolution mechanisms.
16.5. Complaints shall be handled in good faith, within applicable statutory deadlines and, where no specific deadline applies, within a reasonable period.
17. Voluntary Withdrawal from the Program
17.1. Any customer may request withdrawal from the Program at any time, free of charge and without being required to provide a reason.
17.2. To withdraw, the customer must send an email to support@scent.gallery, using or identifying the email address associated with their customer account and expressly requesting removal from the SG Loyalty Program.
17.3. The Operator may request reasonable verification of the account holder’s identity to prevent unauthorized changes to the customer account.
17.4. Withdrawal results in the termination of participation in the Program and the deactivation of loyalty-related earning and redemption functionality associated with the relevant account.
17.5. Upon request, the Operator may inform the customer of their current Points balance before completing the withdrawal process. Following voluntary withdrawal, unused Points will no longer be available for redemption, subject to applicable law and any rights that must legally be preserved.
17.6. Withdrawal from the Program does not automatically result in deletion of the customer’s Shopify account, cancellation of existing orders, or erasure of all personal data.
17.7. Requests concerning the deletion, restriction, or other processing of personal data are handled separately in accordance with Regulation (EU) 2016/679 (GDPR) and the Scent Gallery Privacy Policy.
17.8. Customers are not required to close their customer account in order to withdraw from the Program.
18. Personal Data Protection and Marketing Communications
18.1. For the administration of the Program, the Operator may process personal data necessary for customer identification, eligible purchase records, Points balances, loyalty transactions, reward usage, VIP qualification, and fraud prevention.
18.2. Personal data is processed on the applicable legal bases, for the purposes and retention periods described in the Scent Gallery Privacy Policy.
18.3. Automatic enrollment in the SG Loyalty Program does not constitute consent to receive marketing communications by email, SMS, or other electronic communication channels.
18.4. Where certain rewards are associated with subscribing to marketing communications, the relevant reward is subject to the customer lawfully and effectively completing the qualifying action.
18.5. Withdrawal of marketing consent does not automatically terminate participation in the entire Program. Any effect on benefits specifically linked to a particular eligibility condition shall be subject to the conditions lawfully communicated and applicable data protection requirements.
18.6. Customers may exercise their personal data protection rights using the methods described in the Privacy Policy or by contacting support@scent.gallery.
18.7. Withdrawal from the Program does not require the deletion of information that must be retained under applicable law, including certain financial, accounting, transactional, or legally necessary records.
18.8. The Operator shall apply appropriate technical and organizational measures to protect personal data processed in connection with the Program, in accordance with applicable data protection legislation.
19. Interpretation, Applicable Law, and Consumer Rights
19.1. These Program Rules form an integral part of the general Scent Gallery Terms of Service.
19.2. Specific reward or campaign conditions supplement these Program Rules and apply only insofar as they have been clearly communicated, are accessible to the customer, and comply with applicable law.
19.3. These Program Rules shall be interpreted in accordance with the principles of transparency, proportionality, good faith, and consumer protection.
19.4. If any provision is determined to be invalid, unenforceable, or unfair under applicable law, the remaining provisions shall continue in effect to the extent legally permitted.
19.5. These Program Rules are governed by Romanian law, without prejudice to mandatory consumer protection rights that may apply to customers residing in other jurisdictions under applicable European Union and international private law rules.
19.6. Any dispute may be resolved amicably or through the competent consumer protection authorities, alternative dispute resolution mechanisms, or courts, as permitted by applicable law.
19.7. Nothing in these Program Rules excludes, restricts, or overrides mandatory consumer rights, including statutory withdrawal rights, product conformity rights, protections against unfair commercial practices, or personal data protection rights.
19.8. In the event of a conflict between these Program Rules and mandatory applicable legislation, the mandatory legal provisions shall prevail.
